In the opening statement, while representing Johnny Depp, Benjamin Chew spoke, “Some of you may recognize Mr. Depp from seeing him portray characters such as Edward Scissorhands or Captain Jack Sparrow from Pirates of the Caribbean movies. For nearly 30 years, Mr. Depp built a reputation as one of the most talented actors in Hollywood, a respected artist whose name was associated with success at the box office. Today, his name is associated with a lie, a false statement uttered by his former wife, the defendant Amber Heard.”

He added, “that falsely cast Mr. Depp falsely and unfairly characterized cast, Mr. Depp, as a villain. A man who would violently abuse a woman.”

Benjamin then said, “This is a defamation case. It’s a case about how devastating words can be when they are false and uttered publicly under the law a person who makes a false statement about someone else can be held responsible for the harm that results from that falsehood that’s because words matter”.

He pressed on the point that words “can evoke strong emotions in the listener and cause irreparable harm to a person’s reputation”.

Benjamin also laid out three statements that Amber wrote in her article in The Washington Post in 2018. In the first statement he quote, “I spoke up against se*** violence — and faced our culture’s wrath. That has to change”.

He further pointed out statement number two. He shared, “Then two years ago, I became a public figure representing domestic abuse, and I felt the full force of our culture’s wrath for women who speak out”.

The third statement read, “I had the rare vantage point of seeing, in real-time, how institutions protect men accused of abuse”.

“Ms. Heard didn’t have didn’t use Mr. Depp’s name in the op-ed,” Benjamin spoke aloud in court. “She didn’t have to”. He pointed out that two years before on 27 May 2016, Amber publicly accused Johnny of domestic abuse.

Johnny’s lawyer also talked about Amber walking into court to get the restraining order which she obtained “ex-parte” which meant that ‘Mr. Depp and his lawyer were not there and had no opportunity to be heard”.

Ben is a versatile litigator who has represented clients in complicated commercial litigation and arbitrations in the District of Columbia, Maryland, and Virginia, as well as across the United States and internationally.

He represents clients in a wide range of commercial disputes, including corporate governance, breach of fiduciary duty, defamation, intellectual property, government contracts, breach of contract, class actions, partnership disputes, derivative shareholder and other corporate governance actions, international disputes, Lanham Act, health care, energy, environmental, UCC, products liability, real estate, bankruptcy, employment (including non-compete agreements), insurance law, white-collar defense, fraud, and bankruptcy.

He also filed an I.C.C. arbitration action against the Republic of Ghana.

Ben is still dedicated to pro bono work, having recently represented an African American honors graduate of the University of Virginia in a civil rights complaint against government officials. He represented one of the plaintiffs’ groups in the landmark Black Farmers class-action lawsuit against the US Department of Agriculture, which resulted in a $1.2 billion settlement based on widespread discrimination in farm credit programs.

Moreover, in the concurrent Keepseagle class action, Ben represented a Native American plaintiffs’ organization, which settled for slightly under $1 billion. In a case involving an investigation by the World Anti-Doping Agency, he defended two Olympic gold medalists, Dr. Edwin Moses and Beckie Scott.
