The deaths of four University of Idaho students in November 2022 horrified the country as their off-campus residence quickly turned into a bloody crime scene. One of the victims’ surviving roommates, Bethany Funke, is currently in the news after Bryan Kohberger’s defense team said she could clear his name.
One of the two surviving housemates from the incidental night is Bethany. Prior to their deaths, she shared a home with the students Kaylee Goncalves, Madison Mogen, and Xana Kernodle. The defense team for Kohberger asserted in April 2023 that Bethany may clear his record since she had “information material to the charges against Mr. Kohberger,” which could be “exculpatory” for him, according to E! News.
“Ms. Funke’s information is unique to her experiences and cannot be provided by another witness,” the investigator said, adding that “it is necessary to subpoena this witness because the witness’ testimony is material and necessary to this case,” according to the outlet. However, a lawyer for Bethany disputed the charges made by the investigator, arguing that there was no justification for the defense to ask for a subpoena for the preliminary court hearing, which is set for June 28, 2023.
“These statements are conclusory,” the surviving victim’s attorney wrote in the motion against the subpoena. “There is no further information of detail pertaining to the substance of the testimony, its materiality, or the alleged exculpatory information of Ms. Funke or why it would entertain at a preliminary hearing.”
The motion also pointed out that there is no authority to summon a Nevada witness for an Idaho-based hearing. “A preliminary hearing is not meant to become a mini-trial due to its limited purpose in deciding probable cause,” Bethany’s lawyer added in the motion.
Bethany lived on the first floor with fellow survivor Dylan Mortenson, the person who allegedly came face-to-face with the killer during the night of the attack. In the aftermath of the slayings, Mortensen and surviving housemate Bethany Funke got matching tattoos as a tribute to the victims.
